Terms of Service

Welcome to FindRapidly. These Terms of Service ("Terms") govern your access to and use of the FindRapidly platform, including our website, mobile applications, and all related services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.

FindRapidly is operated by FindRapidly Ltd., a company registered in Ghana ("we", "us", "our").

1. Eligibility

You must be at least 18 years old and legally able to enter into contracts under Ghanaian law to use the Platform. By registering, you represent that you meet these requirements and that all information you provide is accurate and complete.

2. Account Registration

You may register as a Customer, an Artisan, or both. Each role has a separate account tied to your email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorized use.

We may require identity verification ("Know Your Customer" or KYC) before granting access to certain features, including receiving payouts. Providing false or misleading information during verification may result in immediate account termination.

3. Platform Description

FindRapidly is a marketplace that connects customers with skilled artisans for services such as plumbing, electrical work, carpentry, tailoring, and other trades. The Platform also includes a shop for purchasing, renting, and procuring goods and materials, and a sourcing feature for bulk hiring of artisans.

FindRapidly acts as an intermediary. We are not a party to the agreements between customers and artisans or between buyers and sellers. We do not guarantee the quality, safety, or legality of services or goods offered on the Platform.

4. Customer Obligations

  • Provide accurate job descriptions, requirements, and locations.
  • Fund escrow before work begins, as required by the Platform.
  • Communicate respectfully and professionally with artisans.
  • Confirm job completion promptly to release escrowed funds.
  • Not attempt to circumvent the Platform to avoid fees.

5. Artisan Obligations

  • Complete KYC verification before accepting paid jobs.
  • Provide services with reasonable skill, care, and diligence.
  • Only represent qualifications, certifications, and experience that you genuinely possess.
  • Arrive on time and communicate any delays or issues promptly.
  • Not solicit customers to transact outside the Platform to avoid fees.

6. Artisan Accountability & Misconduct

FindRapidly holds artisans to a high standard of professionalism. The following conduct constitutes a serious violation of these Terms, including but not limited to:

  • Accepting payment (whether through the Platform or directly from a customer) and failing to show up for the job.
  • Abandoning a job in progress without reasonable justification or prior agreement with the customer.
  • Becoming unresponsive to a customer's calls, messages, or reasonable attempts to communicate during an active job.
  • Deliberately delaying or prolonging a job in order to charge higher fees or extract additional payments.
  • Causing damage to a customer's property through negligence, recklessness, or intentional misconduct.
  • Collecting payments from customers outside the Platform to circumvent escrow protections.
  • Misrepresenting qualifications, skills, or the scope of work to secure a job.
  • Any form of theft, fraud, or dishonesty in dealings with customers.

Graduated Enforcement

FindRapidly applies a graduated enforcement system for violations. Depending on the severity and circumstances:

  • First offense: Formal warning and account flag. The incident is recorded on the artisan's internal profile.
  • Second offense: Temporary suspension of the artisan's account (duration determined by the severity of the violation).
  • Third offense or severe misconduct: Permanent ban from the Platform.

FindRapidly reserves the right to skip to immediate suspension or permanent ban for severe violations such as theft, fraud, intentional property damage, or threats of violence, without prior warning.

Legal Action

In cases involving fraud, theft, property damage, or other criminal conduct, FindRapidly reserves the right to report the matter to the Ghana Police Service and relevant law enforcement authorities, and to pursue civil legal action against the artisan to recover damages on behalf of the Platform or affected customers. By using the Platform as an artisan, you consent to the disclosure of your account information and KYC records to law enforcement when required by law or when FindRapidly reasonably believes a criminal offense has been committed.

Artisans who cause financial loss or property damage to customers may be held personally liable. FindRapidly may cooperate with affected customers in pursuing legal remedies, and may provide account records, communications, and transaction history as evidence in legal proceedings.

7. Off-Platform Agreements

Any agreements, arrangements, or transactions made between artisans and customers (or any other parties) outside the FindRapidly Platform are entirely at their own risk. FindRapidly is not a party to, and bears no responsibility or liability for, any off-platform agreements, including but not limited to:

  • Private payment arrangements that bypass the Platform's escrow system.
  • Verbal or written contracts made directly between artisans and customers.
  • Additional work or scope changes agreed upon without FindRapidly's knowledge.
  • Any loss, damage, or dispute arising from such arrangements.

FindRapidly strongly advises all users to conduct transactions exclusively through the Platform to benefit from escrow protection, dispute resolution, and the accountability measures described in these Terms.

8. Jobs, Escrow & Payments

When a customer hires an artisan through the Platform, payment is held in escrow until the job is completed and confirmed. FindRapidly charges a commission on completed jobs, which is deducted before funds are released to the artisan's wallet.

Escrow funds are released automatically after the customer confirms completion, or after a defined waiting period if the customer does not respond. Disputes may be raised before funds are released.

All payments are processed through third-party payment providers. By using the Platform, you agree to the terms of these providers. FindRapidly is not responsible for payment processing errors caused by third parties.

9. Shop: Sales, Rentals & Procurement

The FindRapidly Shop allows approved suppliers to list products for sale, rental, or procurement. Buyers agree to the listed prices, rental terms, and return conditions at the time of order. Rental deposits are held in escrow and returned upon satisfactory return of the rented item, subject to inspection.

Pre-orders and procurement requests are subject to supplier availability and lead times. FindRapidly does not guarantee delivery dates for pre-ordered or procured items.

10. Wallet & Payouts

Artisans and suppliers receive earnings into their FindRapidly wallet. Payout requests are processed to the bank account or mobile money number registered on your account. Processing times depend on your payment provider and typically take 1–3 business days.

FindRapidly reserves the right to hold or delay payouts if we suspect fraudulent activity, pending resolution of a dispute, or to comply with legal obligations.

11. Fees & Commissions

FindRapidly charges fees for certain services, including commissions on completed jobs, transaction fees, and optional promotional features. Current fee schedules are displayed on the Platform. We reserve the right to change fees with reasonable advance notice.

12. Prohibited Conduct

You agree not to:

  • Use the Platform for any unlawful purpose.
  • Post false, misleading, or defamatory content.
  • Harass, threaten, or discriminate against other users.
  • Attempt to manipulate reviews or ratings.
  • Circumvent security features or access restrictions.
  • Scrape, crawl, or otherwise extract data from the Platform without permission.
  • Use automated tools to create accounts or interact with the Platform.
  • Facilitate transactions outside the Platform to avoid fees.

13. Content & Intellectual Property

You retain ownership of content you upload (photos, descriptions, portfolio items). By uploading content, you grant FindRapidly a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content on the Platform and in marketing materials.

The FindRapidly name, logo, and all Platform design elements are our intellectual property and may not be used without written permission.

14. Reviews & Ratings

Users may leave reviews after completed transactions. Reviews must be honest, relevant, and based on genuine experience. FindRapidly reserves the right to remove reviews that violate these guidelines or that we reasonably believe to be fraudulent.

15. Dispute Resolution

If a dispute arises between users, FindRapidly may, at its discretion, mediate and make a binding decision regarding the release of escrowed funds. We are not obligated to intervene in every dispute.

For disputes between you and FindRapidly, you agree to first attempt resolution through our support team. If the matter cannot be resolved informally, it shall be submitted to arbitration in Accra, Ghana, under the Alternative Dispute Resolution Act, 2010 (Act 798).

16. Account Suspension & Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or if required by law. Without limiting the foregoing, the misconduct described in Section 6 (Artisan Accountability & Misconduct) shall constitute grounds for suspension or termination under the graduated enforcement framework set out therein.

You may close your account at any time by contacting support. Outstanding obligations (pending jobs, unreleased escrow, unpaid fees) must be settled before account closure.

17. Limitation of Liability

To the maximum extent permitted by law, FindRapidly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of profits, data, or business opportunities.

FindRapidly's total liability for any claim arising from these Terms shall not exceed the total fees you paid to FindRapidly in the twelve (12) months preceding the claim.

18. Indemnification

You agree to indemnify and hold harmless FindRapidly, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

Without limiting the foregoing, artisans specifically agree to indemnify FindRapidly against all claims, damages, and losses arising from:

  • Failure to perform services after accepting payment or a job.
  • Damage to a customer's property caused by negligence, recklessness, or intentional acts.
  • Personal injury or harm caused to customers or third parties during the performance of services.
  • Any agreements, transactions, or arrangements entered into with customers or third parties outside the FindRapidly Platform, whether or not FindRapidly was aware of such arrangements.
  • Fraud, misrepresentation, or dishonest conduct.

FindRapidly acts solely as a marketplace intermediary. FindRapidly does not employ, supervise, or control artisans. FindRapidly shall not be liable for any acts, omissions, negligence, or misconduct of any artisan, whether occurring on or off the Platform.

19. Modifications

We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Continued use of the Platform after changes take effect constitutes your acceptance of the revised Terms.

20. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any legal proceedings shall be brought in the courts of competent jurisdiction in Accra, Ghana.
